Basement Apartment and In-Law Suite in Wichita, KS
A basement suite for a parent, an adult child or a renter starts with zoning, not drywall. Here is what the city says.
- Called an accessory apartment
- Zoning approval first
- Egress and alarms still apply
Licensed and insured. Many years in business serving the greater Wichita area.
What the city calls it
The Wichita-Sedgwick County Unified Zoning Code defines an accessory apartment as an accessory dwelling unit that may be wholly inside a single-family home or detached from it (City of Wichita). A basement suite appears to fit that definition, and planning can confirm it for your lot.
Zoning approval
The city lists a Conditional Use as the current requirement in these districts: RR, SF-20, SF-10, SF-5, TF-3, MH and NO (City of Wichita). Ask planning which district your lot is in before you spend on plans.
Rules that came with approvals
City planning minutes list limits for these units: one accessory apartment per lot, a look that fits the main home, ownership that cannot be split off, and water and sewer that are not a separate service from the main home. Electric, gas and phone can be separate (Wichita planning minutes).
Rules are being updated
The city page lists 2025 and 2026 work on the code. In March 2026 a planning committee recommended administrative permits in the SF-5 and TF-3 districts, and in July 2026 it added a rule that the suite must be subordinate to the main home (City of Wichita). The August 13, 2026 planning commission agenda recommends approving the amendments and sending them to the City Council and County Commission (MAPC agenda). The pages I could read do not show a final vote, so ask planning (316-268-4421) which rules apply on the day you apply.
Building rules still apply
A basement bedroom needs an egress window, smoke alarms on the basement level that are interconnected (Ordinance 50-833), and a permit from MABCD. See the permits guide, the bathroom page and the bedroom page.
Other towns
Andover, Derby, Maize and other towns write their own zoning. Ask your city office before you plan a suite there.
